1. Overview and Acceptance of Terms

Welcome to Shevra! These Terms of Service ("Terms") govern your access to and use of the Shevra website located at www.shevra.com (the "Site"), including any content, functionality, and services offered on or through the Site, and your purchase of products, specifically our hair removal product(s) ("Product" or "Products"), from us. This Site is owned and operated by Shevra ("Shevra," "we," "us," or "our").

By accessing, browsing, or using the Site, creating an account, or purchasing Products from us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree to all of these Terms and the Privacy Policy, you must not access or use the Site or purchase our Products.

These Terms constitute a legally binding agreement between you and Shevra. Please read them carefully.

2. Eligibility and Use of Our Service

We reserve the right to disable any user account at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

4. Products, Pricing, and Availability

We offer a hair removal Product for sale through the Site. We have made every effort to display as accurately as possible the colors and images of our Products that appear on the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

All descriptions of Products or Product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any Product at any time. Any offer for any Product or service made on this site is void where prohibited.

We reserve the right, but are not obligated, to limit the sales of our Products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any Products that we offer.

We do not warrant that the quality of any Products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Please see Section 10 for specific Product Disclaimers.

5. Orders, Payment, and Billing Information

By placing an order through our Site, you are offering to purchase a Product subject to these Terms. All orders are subject to availability and confirmation of the order price.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any transaction. By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of transactions. Verification of information may be required prior to the acknowledgment or completion of any transaction.

6. Shipping and Delivery

Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Title and risk of loss for all Products ordered by you pass to you upon our delivery to the shipping carrier.

You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer or for packages lost or stolen after confirmed delivery by the carrier. Please refer to our separate Shipping Policy for more details.

7. Returns and Refunds

By making a purchase, you agree to the terms outlined in our Returns and Refunds Policy. Generally, eligibility for returns/refunds may depend on the condition of the Product, the time elapsed since purchase, and adherence to return procedures.

In addition to other prohibitions as set forth in the Terms, you are prohibited from using the Site or its content:

The Shevra name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Shevra or its affiliates or licensors. You must not use such marks without the prior written permission of Shevra. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

You are permitted to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows: your computer may temporarily store copies incidental to accessing and viewing materials, and you may store files automatically cached by your web browser for display enhancement purposes. No right, title, or interest in or to the Site or any content on the Site is transferred to you, and all rights not expressly granted are reserved by Shevra.

TO THE FULLEST EXTENT PROVIDED BY LAW, SHEVRA HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE RELATED TO BOTH THE SITE AND THE PRODUCTS SOLD THEREON (EXCEPT AS EXPRESSLY STATED OTHERWISE FOR SPECIFIC PRODUCTS, IF APPLICABLE).

IN NO EVENT SHALL SHEVRA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE OR PURCHASING THE PRODUCTS.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless Shevra, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site, or your use of the Product in a manner inconsistent with instructions or warnings.

13. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of New York, United States without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver: No waiver by Shevra of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Shevra to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without Shevra's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. Shevra may assign or transfer these Terms, at its sole discretion, without restriction.
